Four Bills That Would Change Florida’s Marijuana Laws

Members of Congress have a lot on their plates this year. The laws on hemp and marijuana industries are changing all the time. Florida, for instance, has had many changes to its marijuana laws. Before 2019, it was only permitted to use the drug in pill, oil, edible, and vape form. There is only one democratic marijuana lobbyist in the state of Florida. With the New Year, there is a push for more marijuana reformation. Four bills will change Florida’s marijuana laws.  These laws will help build a way for legalizing recreational marijuana.

House Bill 25

House Bill 25 looks to revise criminal penalties for marijuana crimes. Democrat Rep Shevrin Jones filed House Bill 25. It’s also his first piece of legislation for the 2020 year. This bill will be reducing the punishment for possession of cannabis and THC products. Furthermore, juveniles would be eligible for civil citations or diversion programs. Supporters of the bill hope that the positive outcome would be the reduction of minorities incarcerated due to marijuana charges. The proposal would decriminalize marijuana possession. Anyone arrested could have less jail time and smaller fines. There’s also a possibility to have a clean criminal record. This proposal will make Florida the 27th state to decriminalize marijuana. However, as of right now, Florida law states possession of 20 grams of marijuana is first-degree minor wrongdoing. You can also get jail up to one year or a $1,000 fine or both. Senate Bill 212

Democratic Rep Perry Thurston introduced Senate Bill 212. With this bill, more companies can sell medical marijuana. Supporters for this bill say that it will save the state money and keep families together.

House Bill 149

The next bill is House Bill 149. The bill would change in which companies can grow and sell cannabis. This bill will require the Department of Health to license anyone who produces, processes, transport, or dispenses low THC cannabis, etc. as medical marijuana treatment centers. Before, there was a limit of only 25 facilities per license granted. Representative Anthony Sabatini is the supporter of this bill. He agrees that the cost of a license is too expensive. The Word of Law on Workplace “Drug” Testing

Many public and private employees test their prospective employees and those already on staff for drug use, including marijuana in so-called “legal” states. Most of the time, employers make these tests mandatory, requiring you to submit a sample for testing, and failing to do so might result in employment termination.

But what does the law have to say about employment drug testing? Are workplace and pre-employment drug testing legal or not? Under what circumstance can your employer demand that you submit to drug testing? Can you refuse to take a drug test? What exactly are your rights, and what are your obligations?

To help you understand the legalities surrounding workplace drug testing better, we’ll talk about the conditions under which you should and shouldn’t submit to testing.

The word of the law

Since most employers nowadays strive to create a drug-free work environment, one would think that there are laws regulating workplace drug testing. Unfortunately, that’s not the case, as no federal laws are controlling and governing mandatory drug testing.

However, according to the Drug-Free Workplace Act of 1988, any employer that’s under federal contracting, and receives federal funding has to be drug-free. Which makes transportation, energy production, military, and defense the only industries that have mandatory drug testing regulated by the federal state.

For the rest of us, mandatory drug testing isn’t required by the state. Unless you caused an accident or driven a vehicle under the influence, no one can test you for drugs without your consent. The only exception is court-ordered drug testing, which has to be legally justified to be legally possible.

Under federal law, public and private employers that aren’t funded by the federal state have no right to request mandatory drug testing from their employees. Doing so, under the threat of employment termination, can be considered a violation of human rights, and is therefore illegal.

Legal drug testing

When it comes to workplace drug testing, state laws are a different playing field. The mandatory workplace testing is permitted, but only under the strict supervision of the law. In most states, the law dictates that employers who wish to conduct mandatory drug testing must have a written “drug-free” policy.

The drug-free policy provides the employer with legal rights to request mandatory drug testing from their employees and potential hires. It also serves to provide the employees and the employer with legal protection. And the good news is that, while mandatory testing isn’t governed by the law, drug-free policies are.

An employer that chooses to conduct mandatory drug testing has to provide job applicants and employees a copy of their drug-free policy. So, if you’re applying for a job position that requires pre-employment drug testing, you’ll be given a copy of the drug-free policy, to read and sign.

You can refuse to sign the policy, in which case the employer has no other option but to withdraw the job offer. Employers that chose to conduct drug testing can’t hire you without a signed drug-free policy, regardless of your education, and their hiring needs.

But if you do sign the drug-free policy, you agree to submit to drug testing whenever your employer deems it necessary. This usually leads to pre-employment drug tests and periodic workplace testing.

Pre-employment and workplace testing

Blood and urine collection are two minimally intrusive procedures, as they’re conducted without direct observation and intrusion of privacy. However, due to adulteration concerns, the applicant or employee can be observed producing a sample, by same-sex medical personnel.

Urinalysis or urine drug screen is the most common method of drug testing, due to relatively low cost, and high accuracy. Failing a pre-employment of workplace drug test leaves your employer with no other legal options but to terminate your employment contract. And according to the law, they must do so regardless of your education level, your proficiency, and their employment needs.

The same rule applies in states that have legalized marijuana use since weed is still federally illegal.

What are the rules?

Whether it’s pre-employment or employment testing, your employer must have a drug-free policy installed. If you’re an applicant, the employer has to offer you a job before you’re given a drug-free policy for signing. Without it, any drug testing conducted at the request of the employer can be considered illegal.

Also, the employer has to notify you of an upcoming mandatory drug test; however, the notice period varies from state to state. In some states, that don’t have regulated drug test timing, employees may be tested without advance notice.

The employer must treat you and any other employees or applicants in the same manner. Testing only individual applicants or employees is strictly prohibited and may cause legal issues for the employer. Your employer has to test at least an entire department you work in, or at least 50% of all employees for testing to be legal.

Individual testing is only allowed when there’s a “reasonable suspicion” that you’re taking drugs. Causing any kind of workplace accident, injury, and playing hide and seek while driving bulldozers on company grounds is considered “reasonable suspicion.”

Your employer has no rights to test you covertly, without your consent or knowledge. Any test results, even positive ones, are invalid if the testing is conducted without your permission. Testing you without consent, and terminating your employment contract based on invalid test results can have severe legal repercussions for the employer.

Lastly, testing must be conducted by the laboratories approved by the court and the state. Similar to covert testing, any tests performed by unapproved labs are considered invalid.

Every business wants to hire employees who are goal-driven and have the zeal to work hard to achieve them. The question is subjective and there is no right answer or wrong answer. Nevada Cannabis Law: An Example for Other States?

Legalizing cannabis for both medical and recreational use in Nevada has been on the agenda for a lot longer than much of the USA. Nevada has always been something of an outlier for laws in America, and doesn’t necessarily follow what is going on in other states.

Cannabis has been “decriminalized” for a lot longer than it has been technically legal for recreational use. The Bill which legalized the medical use of cannabis way back in 2001, had a provision that said that possessing up to one ounce would result in fines for first-time or even second-time offenders. You’d have to commit the offense three times to risk getting any sort of criminal record.

In this regard, the approach was a lot more relaxed than a lot of the USA. Some would have said too relaxed, but attitudes are changing. Nevada was the fifth state to legalize medical cannabis, and has followed suit when it comes to recreational cannabis by being early adopters. However, the control over the cannabis is done very well, and is an example to follow for some of the states which don’t think they’re ready to legalize.

Getting the Limits Right

Nevada and Las Vegas are not pushovers when it comes to cannabis. From the outside looking in, and knowing that cannabis has been decriminalized for so long, you might think that it is a bit of a free-for-all. This is far from the case.

Cannabis is treated in a similar way to alcohol, with a bit more strict regulation. While you are allowed to consume it, that doesn’t mean you can do what you want. There are limits to how much you can buy at a time, how much you can possess and what you can do when you’ve consumed cannabis products.

Limits are usually in place when making any sort of cannabis legal. If there weren’t, things could quickly get out of hand.

For recreational users, ⅛ oz of concentrate is available each purchase. This has a 15% tax applied to it. If you have a medical marijuana card, you can purchase 2.5o oz every two weeks. MMR cards are not handed out to just anyone, doctors need to be consulted and sign off on the cards.

One of the key differences between having a card and not having a card is the fact that 18-year-olds can obtain cannabis for medical use, whereas for recreational use you need to be 21.

Cracking Down on Growth

The cannabis laws mean that it cannot be grown within 50 miles of anywhere that cannabis is legally dispensed. This is designed to stop people from growing their own. Cannabis is very easy to grow compared to a lot of other substances.

So why can’t people grow their own?

Well, the restrictions on growing it mean that there is a far lesser chance of people pushing their luck and trying to create their own cottage industry selling to friends or worse. There’s also a greater chance of taking the cannabis over state lines to places where it is not legal.

If there were no restrictions on people growing their own cannabis then police would not be able to intervene when they discovered people growing plants, even if it was pretty obvious that it was not for personal consumption.

Why does this matter?

Well, one of the key benefits of the laws for cannabis is the fact that it can raise a lot of money in taxes. This money can even be used to help people who are struggling with addictions and drug problems. If you take away restrictions, you would also be taking away this control.

An Example to Follow

How is this an example to follow?

Well, by limiting the purchase and consumption, and not making it as easy as going into a corner shop like buying a bottle of whiskey, the authorities have reduced the chances of illegal selling of cannabis, exporting to other states or countries where it is not legal, or acting dangerously when under the influence.

State Senator Tick Segerblom has been quoted as saying that legalized cannabis has been an “overwhelming success” for Nevada. It has seen money raised in taxes, jobs created, and has had no significant impact on the strain on emergency services, for instance. People are respecting the cannabis laws and generally not driving under the influence or causing disruptions as a result.

The taxation gives an income stream to local authorities. This money may be much needed. In areas which are deprived, but people are still taking cannabis, the example set by Nevada could be one to follow. It can lead to better control and raise funds for helping with local issues.

As a result of the measures put in place, very few incidents have been recorded with people abusing the law.

The only criticism you could realistically aim at the state’s handling of cannabis is that the prices are expensive. People have been tempted to grow their own, though this is not legal within 25 miles of a dispensary. Over time, I expect the prices to come down.

This rapidly growing sector is having real time job openings. Though Cannabis is legal only in two-thirds of states, its variety of service roles speaks for its uniqueness.

This industry stretches from direct full-time-equivalent jobs to indirect and induced full time equivalent jobs which could be categorized as: service and retail; professional and technical; labour and physical.

Business and employing remains the strongest base in cannabis industry as investment. On the other hand, hiring indicates business confidence which requires long-term investment of time, effort and money. Majority of employers hiring in the Cannabis industry ranges from small to medium business that cultivate, process and sell the products.

Cannabis: A Huge Job Creator

According to a recent Cannabis radar report, “In 2019, more than 211,000 Americans support their families and communities with legal cannabis jobs.”

Increasing demands and jobs have set some expectations as per now, In December 2017 there were 858 job listings which in December 2018 were increased to 1,512 cannabis related job openings. That is 76 percent year-over-year increase.

Some states that have had legal adult use cannabis for a long time have now opened the stores and are now seeing the growth in cannabis jobs.

As more states continue to legalize cannabis for adult and medical use, the number of jobs will rise exponentially. Half of the workforce is made up by the professional and technical workers, such as accountants, lab workers, marketers and tax experts.

  • In 2019 the number increased to more than 211,000.
  • US added 64,389 full-time jobs in 2018.

  • Legal cannabis sales increased 34% nationwide in 2018, to $10.8 billion.
  • Small to medium business with less than 500 employees account for 84% of job openings.
  • 53% of cannabis jobs openings are for professional and technical workers.

Do you see any growth in the Cannabis Industry?

There has been a rapid growth in this industry from past few years. From employment to legalisation of cannabis in various states the graph has gone higher.

The bureau of labour statistics recently compiled a list of the industries with the fastest growing employment figures and their expected growth over 10 years:

  • Home and health aides – 6%
  • Wind turbine technicians – 9%
  • Solar photovoltaic installers – 3%

The Florida minimum wage is $8.46 per hour, but median wages for “other-category” retail jobs in Florida — where marijuana jobs are lumped — rose to $15.99 per hour in 2018.

On the other hand, Matt Hansel, a medical practitioner and researcher at Greenthevoteok said – “CBD has brought a revolution in the Cannabis sector flourishing it with abundant job opportunities.” He thinks that opportunities in cannabis can increase more rapidly with the legalisation issues resolved.

Beau Whitney, the Oregon based economist and founder of Whitney economics has been actively involved in the job count of cannabis industry. Even many of the government economists are working to quantify these jobs.
